Welcome to Aspire Aviation Flight School (“Aspire Aviation,” “Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, services, flight training programs, aircraft rental services, and related offerings.

By accessing or using our website, enrolling in training, scheduling services, or otherwise engaging with Aspire Aviation, you agree to be bound by these Terms. If you do not agree, please discontinue use of our website and services.

1. Company Information

Aspire Aviation Flight School provides aviation education, flight training, aircraft rental, aviation consulting, and related services.

All services are subject to applicable federal, state, and local laws, regulations, and aviation standards.

2. Eligibility

By using our services, you represent and warrant that:

  • You are at least 18 years of age, or have the consent of a parent or legal guardian.
  • You possess the legal capacity to enter into binding agreements.

  • You will comply with all applicable aviation laws and regulations.

Aspire Aviation reserves the right to refuse service or terminate participation at its sole discretion.

3. Flight Training Services

Enrollment in flight training does not guarantee:

  • Issuance of any pilot certificate or rating;
  • Completion within a specific timeframe;
  • Employment opportunities;
  • Qualification for airline or commercial positions.

Student progress depends on numerous factors, including:

  • Attendance
  • Skill development
  • Regulatory requirements
  • Medical eligibility
  • Weather conditions
  • Instructor availability
  • Aircraft availability

Aspire Aviation makes no guarantee regarding training outcomes.

4. FAA and TSA Compliance

Students are solely responsible for maintaining eligibility under all applicable requirements imposed by:

  • Federal Aviation Administration
  • Transportation Security Administration

Students agree to:

  • Provide accurate citizenship and identification documentation.
  • Maintain valid medical certification when required.
  • Disclose any regulatory restrictions affecting training eligibility.
  • Comply with all security screening requirements.

Failure to comply may result in suspension or termination of training.

5. Scheduling and Cancellations

Student Cancellations

Students must provide at least 24 hours’ notice for cancellation or rescheduling of:

  • Flight lessons
  • Simulator sessions
  • Ground instruction
  • Checkouts and evaluations

Failure to provide timely notice may result in cancellation fees or forfeiture of prepaid training time.

Weather and Safety Delays

Aspire Aviation reserves the right to:

  • Cancel flights due to weather
  • Delay flights for maintenance
  • Reschedule instruction for safety reasons
  • Modify schedules based on operational needs

Safety decisions are final and non-negotiable.

6. Payments and Refunds

Fees

Students agree to pay all applicable:

  • Tuition
  • Aircraft rental fees
  • Instructor fees
  • Fuel surcharges (if applicable)
  • Testing fees
  • Administrative fees

Prices are subject to change without notice.

Refund Policy

Unless otherwise stated in a signed enrollment agreement:

  • Services already rendered are non-refundable.
  • Aircraft rental time used is non-refundable.
  • Instructor time completed is non-refundable.
  • Deposits may be non-refundable.
  • Refund requests are reviewed on a case-by-case basis.

Any approved refund may be subject to administrative processing fees.

7. Aircraft Rental

Aircraft rental privileges are subject to:

  • Instructor approval
  • Currency requirements
  • Compliance with rental policies
  • Completion of required checkouts

Aspire Aviation may suspend or revoke rental privileges at any time.

Aircraft availability is not guaranteed.

8. Assumption of Risk

Aviation activities involve inherent risks, including but not limited to:

  • Aircraft accidents
  • Equipment malfunction
  • Weather-related hazards
  • Personal injury
  • Property damage
  • Serious bodily injury
  • Death

By participating in flight training or aviation activities, you voluntarily assume all risks associated with aviation operations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASPIRE AVIATION SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT DAMAGES
  • INCIDENTAL DAMAGES
  • SPECIAL DAMAGES
  • CONSEQUENTIAL DAMAGES
  • PUNITIVE DAMAGES
  • LOST PROFITS
  • LOST OPPORTUNITIES
  • LOSS OF DATA

ARISING FROM:

  • WEBSITE USE
  • TRAINING SERVICES
  • AIRCRAFT RENTAL
  • FLIGHT OPERATIONS
  • DELAYS OR CANCELLATIONS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

10. Release and Indemnification

You agree to defend, indemnify, and hold harmless Aspire Aviation, its owners, officers, employees, instructors, contractors, affiliates, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your participation in training
  • Violation of these Terms
  • Violation of law
  • Misuse of aircraft or equipment
  • Negligent or intentional acts

11. Website Use

You agree not to:

  • Violate any law or regulation
  • Attempt unauthorized access to systems
  • Upload malicious software
  • Interfere with website functionality
  • Copy or distribute protected content without permission
  • Use the website for fraudulent purposes

We reserve the right to restrict access to any user who violates these Terms.

12. Intellectual Property

  • Photographs

is owned by Aspire Aviation or licensed to Aspire Aviation and protected by applicable intellectual property laws.

Termination does not eliminate outstanding payment obligations.

Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Jefferson County, Alabama, and each party consents to the jurisdiction of those courts.

19. Dispute Resolution

Before filing any lawsuit, the parties agree to attempt to resolve disputes through good-faith negotiations.

If a dispute cannot be resolved informally, either party may pursue available legal remedies in a court of competent jurisdiction.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any signed training, rental, or enrollment agreements, constitute the entire agreement between Aspire Aviation and the user regarding the use of the website and services.
